Understanding Harrell Aviation's Role
Harrell Aviation LLC operates as an Air Charter Broker and Indirect Air Carrier, providing comprehensive private aviation services to discerning travelers worldwide. We specialize in:
- On-Demand Charter Services: Single-trip charter arrangements for any destination.
- Harrell Aviation Jet Card Program: Membership-based access with predictable hourly pricing.
- Concierge Aviation Services: End-to-end coordination including catering, ground transportation, and itinerary management.
Critical Distinction — Our Role as a Broker
Harrell Aviation acts as an intermediary connecting you with FAA-certified Direct Air Carriers who operate the aircraft. We do not own, operate, or exercise operational control over any aircraft. When you book a flight through Harrell Aviation:
- You enter into a separate charter agreement directly with the aircraft operator (Direct Air Carrier)
- The operator maintains full operational control and responsibility for the flight
- Harrell Aviation facilitates the booking but is not a party to the charter agreement between you and the operator
- Any claims related to flight operations, safety, delays, or cancellations must be directed to the operating carrier
- Harrell Aviation's liability is limited to our role as a broker, not as an aircraft operator
All aircraft operators in our network are properly licensed U.S. and/or foreign Direct Air Carriers who meet or exceed safety standards recognized by WYVERN, ARGUS, NBAA, and EBAA.
Eligibility and Acceptance
To use Harrell Aviation's Services, you must meet the following requirements:
- You must be at least 18 years of age and have the legal capacity to enter into binding contracts
- You must provide accurate, complete, and current information when creating an account or booking flights
- You must not be prohibited from using our Services under applicable laws or regulations
- If you are accessing Services on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms
Modifications to These Terms
Harrell Aviation may modify, update, or revise these Terms at any time to reflect changes in our Services, business practices, legal requirements, or for other operational reasons. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
Permitted Use of Services
Harrell Aviation grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for their intended purposes:
- Personal Use: Booking flights for yourself, your family, and authorized guests.
- Business Use: Booking flights for your company's executives, staff, and clients within the scope of your authority.
- Legitimate Purposes: Lawful travel that complies with all applicable aviation, export, and sanctions regulations.
Account Registration and Security
Creating an account with Harrell Aviation provides enhanced features including faster booking, saved preferences, flight history, and access to exclusive jet card programs. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Prohibited Activities and Restrictions
To maintain the integrity, security, and quality of our Services, you agree NOT to engage in any illegal or harmful conduct, security or technical violations, intellectual property violations, or abusive behavior. Violation of these restrictions may result in immediate termination of your access, cancellation of bookings without refund, legal action, and reporting to appropriate authorities.
Intellectual Property Ownership
All content, features, and functionality available through Harrell Aviation's Services are owned by Harrell Aviation LLC, our licensors, or other content providers and are protected by United States and international intellectual property laws.
Subject to your compliance with these Terms, Harrell Aviation grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our Services for personal or internal business purposes only.

- Payment Methods: We accept major credit cards, wire transfers, and other approved payment methods.
- Deposits: Many charter bookings require a deposit at the time of confirmation, with the balance due before departure.
- Additional Charges: Fuel surcharges, landing fees, overnight fees, catering, ground transportation, and other ancillary services may apply.
Cancellation and Refund Policy
Cancellation terms vary depending on the type of service. On-Demand Charters may have cancellation fees based on the operator's policies and proximity to departure. Jet Card Programs follow the cancellation rules in your specific jet card agreement. Weather and Safety Cancellations are handled in accordance with the operator's policies and applicable regulations.
Disclaimers of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARRELL AVIATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, ACCURACY, AND THIRD-PARTY SERVICES.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HARRELL AVIATION SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
IN NO EVENT SHALL HARRELL AVIATION'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS ($100), OR (B) THE TOTAL AMOUNT YOU PAID TO HARRELL AVIATION IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless Harrell Aviation and its officers, directors, employees, agents, affiliates, and licensors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of our Services, violation of these Terms, violation of any third-party rights, violation of any applicable laws, or any content you submit through our Services.
Dispute Resolution and Arbitration
Before initiating arbitration or litigation, you agree to first contact Harrell Aviation at fly@harrellaviation.com to attempt to resolve any dispute informally within 60 days. If informal resolution is unsuccessful, any dispute shall be resolved through final and binding arbitration in San Diego County, California.
Class Action Waiver
YOU AND HARRELL AVIATION AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR ANY OTHER PROCEEDING WHERE SOMEONE ACTS IN A REPRESENTATIVE CAPACITY.
Governing Law and Jurisdiction
These Terms of Service shall be governed by the Federal Arbitration Act for arbitration matters, federal aviation laws and regulations, and the laws of the State of California. For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
Termination of Services
You may stop using Harrell Aviation's Services at any time. Harrell Aviation reserves the right to suspend, restrict, or terminate your access to our Services at any time, with or without notice, for any reason permitted by these Terms. Upon termination, your right to access and use the Services immediately ceases, but outstanding payment obligations remain due and payable.
General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and any booking-specific charter agreements, constitute the entire agreement.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
- No Waiver: Our failure to enforce any right or provision is not a waiver of that right.
- Assignment: You may not assign these Terms without our written consent.
- Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
